Default Used trailer purchase

I am looking at some small used single axle trailers on Craigslist and I found one I really want. The ad doesn’t state anything about a title or certificate of origin. As a Kansas resident who would use this in Missouri, if he seller doesn’t have a title will this be an issue? The only thing I worry is if any of these trailers are stolen. I know the trailer and whatever I haul on it will be under 2,000 pounds. I don’t think I will have to register it at all since the trailer and payload are less than 2M. I have seen some trailers with plates that say “under 2M”.

I am unsure so I don’t want to get myself in a pickle.

Btw. This is a single axle, 5ft wide by 8 feet long. Nothing fancy. Maybe 2 motorcycles or a big riding lawn mower to carry around. Flat bed with loading ramp.

Is it too good of a deal? When I needed a trailer, I ended up getting mine just as cheap, brand new at Tractor Supply.

I've run into this problem with larger trailers. People are just lazy and don't want to pay the sales tax or property taxes each year so just roll the dice and don't report the purchase (typically bought out of state).

Small trailers like the one you are looking at are exempt. Bill of sale should be adequate.

From KS DMV:

Quote:
Kansas law requires trailers to be titled and registered. There are three exceptions to the trailer titling/registration requirement. The three exceptions are:
  1. Farm trailers hauling 6,000 pounds or less of agricultural product are exempt from title and registration. The weight of the trailer itself is not figured as part of the 6,000 pounds.
  2. Farm trailers used and designed for transporting hay or forage from a field to a storage area or from a storage area to a feedlot, which is only incidentally moved or operated upon the highways, except this exception does not apply to farm semitrailers; and
  3. Trailer with an operating weight of 2,000 pounds or less may be titled and registered at the owner’s option, they are not required to be titled and registered. Operating weight means the total weight of the trailer and any load transported thereon. A trailer meeting the 2,000 pounds exemption may be sold on a bill of sale.

I have a 5x8 trailer and because it has a capacity of 3500#'s, the dealer told me I'm technically required to tag and register it. So I have for years. I have no problem paying $40/year to make sure everything is legal.

That said, most 5x8 trailers do have a max capacity of 2000#'s and are exempt.

Mines a 5x8 as well. I live in Missouri, have to register it, and just paid a one time fee for a permanent tag (P) so I never have to dick with the dmv again.

OP is right on people not paying the taxes on it (which is really cheap). Also, it could be a homemade trailer, which wouldn't have a title, but you can usually tell the difference between the two.

When I bought a small boat for duck hunting, it came with a trailer like what you’re talking about and it was from MO. I registered the boat but not the trailer (as KS law dictates) and do not carry any kind of bill of sale at all on the trailer. Have been checked by game wardens at least 5 times and never have had any issues. Long as the GVWR is under 2000 lbs, you’re good to go. Copy the bill of sale and throw it in your glove box if you really want to be safe about it.

Thanks for the info guys. I’m guessing the trailer is stolen because I have emailed the guy twice and he won’t respond as I ask if any paperwork accompanies the trailer and no response at all. It kind of is a too good to be true. I’m guessing he is selling it cheap because he knows it is not legit.
